What Personal Data We Collect and Why We Collect It

Tingen Law, PLLC collects the types of data that websites routinely collect to interact with its visitors via online forms and comment forms, as well as via technical processes such as cookies, analytics, and interactions with software provided by third party websites.

However, as a law firm, we also collect client and case-specific information for site visitors who seek to engage the firm’s services.

This information includes, but is not limited to, information such as your name, email address, IP address, physical address, documents you upload or provide to the firm, and other information relevant to pursuing your legal matter.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it.

After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

To power contact form and email form interactions on our websites, we use a combination of the Gravity Forms Plugin, the form functionality of the Elementor website builder, and the automated response systems available in ActiveCampaign.

Personal information collected from your form interactions are not shared with Gravity Forms, Elementor, or ActiveCampaign.

We may use email addresses collected by any means on our website to send email marketing campaigns via ActiveCampaign.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment.

How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Client information, for site visitors and users who retain the firm for legal services, is retained indefinitely. Clients may also request, in writing, that information relating to their case be removed from our records, both digital and physical.

Use of Site in Furtherance of Providing Legal Services

Our use of our websites is unique in that we interact with, store, collect, and process information provided by clients via our online presence. We collect and use client information in this manner in order to provide a superior legal service experience.

As a result, in specific interactions where it is indicated that an attorney-client relationship is formed, clients may provide additional private information that goes beyond a normal site visitor interaction to merely process technical, marketing, or communication information.

Third Party Software: ActiveCampaign

We may provide visitor email addresses and other information to ActiveCampaign for email marketing purposes. (https://www.activecampaign.com/legal/privacy-policy). ActiveCampaign sends email to visitors who have provided an email address to Tingen Law, and provides non-identifying aggregate information in the form of statistics to help us improve our email marketing efforts.

Third Party Software: Stripe

We use Stripe to process payments online. Stripe may store, collect, or share personal data in accordance with their privacy practices in order to allow you to pay for products or services. (https://stripe.com/us/privacy).

While we currently only use Stripe to process payments online, we may use other point of sale products or payment processors in our office, or online in the future. We will only share the information necessary to process payment with those third parties.

Third Party Software: Shopify

One of the Tingen Law websites is hosted via Shopify. (https://www.shopify.com/legal/privacy). Shopify may also collect personally identifying information necessary to process transactions. They retain client and site visitor information in accordance with their privacy practices.

Our Shopify store uses the Stripe payment gateway to process payment.

Third Party Software: Freshbooks

We use Freshbooks to process invoices for clients. (https://www.freshbooks.com/policies/privacy). Client information, such as your name, email, phone, and physical address, is submitted to Freshbooks automatically upon submission of certain forms indicating that an attorney-client relationship has been formed. This information is provided to Freshbooks so that we may invoice you for services provided.

WordPress Plugins: Akismet

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

WordPress Plugins: WooCommerce

We collect information about you during the checkout process on our store.

While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

We generally store information about you indefinitely, or as long as needed for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them.

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information such as what was purchased, when it was purchased and where it should be sent, and
  • Customer information such as your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.

WordPress Plugins: WooCommerce Subscriptions

For the purposes of processing recurring subscription payments, we store the customer’s name, billing address, shipping address, email address, phone number and credit card/payment details.

We share the information necessary to process automatic payments in accordance with your subscription with Stripe, as previously mentioned.
